PRIVACY POLICY

This policy explains what personal information THE.CCART collects, why we collect it, and your rights. It covers collectors, people on our mailing list, artists who apply to or work with us, and anyone who visits theccart.com.

1. WHO WE ARE

THE.CCART is run by Kunbi Oshodi, a sole trader trading as THE.CCART, who is responsible for your personal information (the "controller"). Address: Suite RA01, 195-197 Wood Street, London, E17 3NU, London, United Kingdom. Email: info@theccart.com

2. WHAT WE COLLECT AND WHY

Our mailing list

  • What: if you sign up, your email address, and your name if you give it. Anyone can join: collectors, artists and anyone interested in our work.

  • Why: to send you news from THE.CCART, including new works, exhibitions, artist features and open calls.

  • Legal basis: your consent. You can unsubscribe at any time using the link in every email.

Enquiries and orders

  • What: your name, email address, phone number if you give it, delivery address and country, the artwork you're interested in, and any messages you send us. If there's a problem with a delivery, also the photos and videos you send us.

  • Why: to quote you, process your order, arrange delivery, handle returns and insurance claims, keep business records, and keep a record of the sale so we can confirm the artwork's history (its provenance) if you or a future owner ever need it.

  • Legal basis: to take the steps you ask for before buying and to carry out your order; to meet our legal duty to keep tax records; and our legitimate interest in handling insurance claims and keeping provenance records.

  • Payments: card details are handled by our payment provider. We never see or store your full card number.

Artists

  • What: if you apply to an open call or work with us, your name, contact details, country, website and social media links, biography, artist statement and images of your work. If we work together, also your address, our signed agreement, and the bank details you give us for payments.

  • Why: to review applications, carry out our agreement with you, promote your work and pay you.

  • Legal basis: to take steps before entering into an agreement and to carry it out; our legitimate interest in running a fair selection process; and our legal duty to keep tax records. How we may use your images and content is set out in your artist agreement.

Website visitors

  • Our website is hosted by Wix. It uses cookies that the site needs to work and, only if you agree, cookies that help us understand how the site is used. You can change your choices at any time in the website's cookie settings.

  • If you contact us on social media, that platform's own privacy policy also applies.

3. WHO WE SHARE IT WITH

We never sell your information. We share it only when needed:

  • Artists: if you buy a work, we give the artist your name and delivery address so they can send it. They may use these only for that delivery. We don't give artists your email address or phone number.

  • Couriers: your name and delivery address appear on the shipping label and customs paperwork.

  • Service providers who help us run THE.CCART, such as our website host (Wix), our payment provider, our email provider and professional advisers such as an accountant.

  • Authorities, such as HMRC, when the law requires it.

4. SENDING INFORMATION OUTSIDE THE UK

Our artists are based mainly in Africa and the Caribbean. When you buy a work, your name and delivery address are sent to the artist in their country so they can ship it to you. We send only what's needed for delivery. Some of our service providers, including Wix, also store data outside the UK. Where they do, they use safeguards approved under UK data protection law.

5. HOW LONG WE KEEP IT

  • Mailing list: until you unsubscribe.

  • Enquiries that don't lead to a sale: 12 months.

  • Orders and payments: 7 years, to meet HMRC's record-keeping rules.

  • Photos and videos of a damaged delivery: until the claim is settled, then deleted within 12 months.

  • Open call applications that aren't selected: deleted within 12 months of the decision.

  • Artists we work with: while we work together, then 7 years for financial records.

  • Provenance records (the artwork, the artist, the buyer's name and the date of sale): for as long as THE.CCART operates, to confirm each artwork's history and authenticity.

6. KEEPING IT SAFE

We keep your information in secure, password-protected accounts and limit who can see it. Artists must delete buyers' details once the delivery and any claim are complete.

7. YOUR RIGHTS

You have the right to:

  • ask for a copy of your information

  • ask us to correct it

  • ask us to delete it

  • ask us to limit how we use it

  • object to how we use it, including stopping marketing emails at any time

  • ask us to send it to another organisation

  • withdraw your consent at any time, where we rely on consent

To use any of these rights, email info@theccart.com. We'll reply within one month. Some rights have limits. For example, we must keep order records for tax purposes. We don't make decisions about you using only automated processes, including profiling.

8. COMPLAINTS

If you're unhappy with how we've handled your information, please tell us first at info@theccart.com. You can also complain to the Information Commissioner's Office (ICO) at ico.org.uk/make-a-complaint or on 0303 123 1113.
